Welcome to WhereToChat.us. By accessing or using this website, you agree to comply with and be bound by the following Terms of Service ("Terms"). If you do not agree to these Terms, please do not use this site.

1. No Service Level Guarantee (No SLA)

WhereToChat.us does not provide any service level agreement (SLA) or uptime guarantee.

  • The service is provided "as is" and "as available."
  • We do not guarantee 24/7 availability or uninterrupted service.
  • Downtime may occur due to server issues, maintenance, Railway.app outages, or third-party failures.
  • WhereToChat.us is not responsible for any business losses due to service interruptions.
  • You agree not to hold us liable for any outages, message delays, or feature malfunctions.

If uptime and guaranteed performance are critical for your business, we recommend hosting Chatwoot on your own infrastructure.

2. No Support Policy – You Are On Your Own

WhereToChat.us does not provide technical support, customer service, or troubleshooting of any kind.

  • We have simply installed and configured Chatwoot on Railway.app for users who don’t want to set it up themselves.
  • We charge Railway’s hosting fees + a small percentage markup to cover the effort of setting it up.
  • If something isn’t working and you cannot get it to work, your only option is to:
    1. Fix it yourself.
    2. Find another service elsewhere (which will cost significantly more).

We do not provide:

  • Bug fixes
  • Feature requests
  • Account recovery assistance
  • Customization help
  • Installation support

You're welcome to send us comments or suggestions, but we do not guarantee any response or action on them.

If you need a fully supported Chatwoot instance, we recommend signing up for Chatwoot’s official cloud service instead.

3. Acceptance of Terms

By accessing or using WhereToChat.us ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms may be updated from time to time without prior notice. Continued use of the Site constitutes your acceptance of any changes.

4. Intellectual Property & Third-Party References

  • WhereToChat.us™ is a registered trademark. All rights are reserved.
  • You may not use the WhereToChat.us name, logo, or branding without prior written permission.
  • Any content, features, or materials on the Site are owned by WhereToChat.us or its licensors.
  • Third-Party Intellectual Property Disclaimer: If any third-party names, trademarks, or brands are referenced on this site, we do so only for informational or integration purposes.
    • WhereToChat.us does not claim any ownership or affiliation with third-party brands, APIs, or trademarks.
    • Any rights associated with those names, logos, or services remain the exclusive property of their respective owners.
    • References to external services (e.g., social media, APIs, integrations) do not imply endorsement or sponsorship by those companies.

5. Metered Billing and Payment

WhereToChat.us operates on a metered billing model, meaning:

  • You will be charged per message, per conversation, or per agent usage, as outlined in our Pricing Policy.
  • You are responsible for all fees incurred on your account.
  • Fees include Railway.app hosting fees + 25%, or a fixed per-message rate.
  • Payments are processed automatically via Stripe.
  • There are no refunds once usage is billed.

Failure to pay may result in suspension or termination of your account.

6. Open-Source Software & Chatwoot MIT License

WhereToChat.us is powered by Chatwoot, an open-source customer support software licensed under the MIT License.

MIT License Notice:

  • Chatwoot is free software provided “as is,” without warranties.
  • WhereToChat.us does not modify the core Chatwoot software but provides hosting, billing, and metered usage on top of the platform.
  • The original Chatwoot project is available at https://github.com/chatwoot/chatwoot.

7. Third-Party Services & Railway.com Hosting

WhereToChat.us is hosted on Railway.app. By using WhereToChat.us, you also agree to Railway’s Terms of Service, available at:https://railway.app/legal/terms

  • WhereToChat.us has no control over Railway’s infrastructure, pricing, or service stability.
  • If Railway experiences downtime, WhereToChat.us is not liable for interruptions in service.

8. Limitation of Liability

To the fullest extent permitted by law, WhereToChat.us shall not be liable for:

  • Direct, indirect, incidental, or consequential damages from service interruptions.
  • Loss of revenue or business due to downtime, errors, or billing issues.
  • Data breaches or unauthorized access to user data.

Total liability for any claim shall not exceed the total amount paid by you to WhereToChat.us in the past 30 days.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state of Ohio.

10. Alternative Dispute Resolution & No Class Actions

  • Any disputes shall be resolved via binding arbitration under AAA (American Arbitration Association) rules.
  • The arbitration shall take place in Ohio.
  • No class-action lawsuits against WhereToChat.us are permitted.

If arbitration is not allowed by law, disputes shall be resolved in Ohio courts.

11. Changes to the Terms

WhereToChat.us may modify these Terms at any time. Changes will be effective immediately upon posting. It is your responsibility to review these Terms periodically.
